Terms and Conditions of Sale

These Terms and Conditions apply to all sales of goods and digital products supplied by Advanture Ltd ("we", "our", "us"). By placing an order, you agree to be bound by these Terms.


1. Definitions

In these Terms:

  • Seller means Advanture Ltd.

  • Customer means the person or business purchasing the goods or digital products.

  • Goods means any physical products supplied by us.

  • Digital Products means downloadable files, plans, drawings, templates, software or other electronic content.

  • Contract means the agreement between the Seller and the Customer.


2. General

2.1 These Terms apply to all sales unless otherwise agreed in writing.

2.2 No variation to these Terms shall be binding unless agreed in writing by an authorised representative of Advanture Ltd.

2.3 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force.


3. Products

3.1 Product descriptions, images and specifications are intended as a guide only.

3.2 We reserve the right to improve or modify products without prior notice, provided the substituted product is of equivalent quality and functionality.


4. Prices

4.1 Prices shown include VAT where applicable unless stated otherwise.

4.2 Delivery charges are shown separately during checkout.

4.3 We reserve the right to amend prices at any time before an order is accepted.

4.4 Obvious pricing errors may be corrected before an order is accepted.


5. Payment

5.1 Payment is required before dispatch unless a business credit account has been agreed.

5.2 Business account customers shall pay invoices within the agreed credit period.

5.3 We reserve the right to charge interest on overdue business accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.


6. Order Acceptance

A contract is formed only when we confirm acceptance of your order.

We reserve the right to refuse or cancel an order where:

  • payment cannot be authorised;

  • goods are unavailable;

  • an obvious pricing error has occurred;

  • fraud is suspected.


7. Cancellation Before Dispatch

Customers may cancel an order before dispatch by contacting us.

Where cancellation is requested for reasons not attributable to Advanture Ltd (including ordering in error, accidental purchases or change of mind), we reserve the right to deduct an administration charge of 5% of the order value to cover non-recoverable payment processing charges and administration costs.

No charge will apply where cancellation is due to our error or inability to fulfil the order.

Orders for bespoke or personalised products cannot be cancelled once manufacture has commenced.


8. Delivery

Delivery dates are estimates only.

While every effort is made to dispatch promptly, we shall not be liable for delays caused by carriers, manufacturers, weather, customs or events outside our reasonable control.

Risk in the goods passes to the customer upon delivery.

Ownership remains with Advanture Ltd until payment has been received in full.


9. Inspection of Goods

Customers should inspect deliveries promptly.

Any transport damage, shortages or incorrect items should be reported within 48 hours of delivery where reasonably possible.

This does not affect your statutory rights regarding faulty goods.


10. Consumer Cancellation Rights

If you are purchasing as a consumer, you have the right to cancel your order within 14 days of receiving your goods under the Consumer Contracts Regulations 2013.

To cancel, you must notify us within the cancellation period.

You then have a further 14 days to return the goods.


11. Returns

Unless goods are faulty, damaged or supplied incorrectly:

  • return postage is the customer's responsibility;

  • goods must be returned in a resaleable condition;

  • all original packaging should be included where reasonably possible.

Customers remain responsible for returned goods until they are received by us.


12. Refunds

Refunds will normally be made within 14 days of receiving returned goods.

Where returned goods show signs of use beyond what is necessary to inspect them, we reserve the right to reduce the refund to reflect any reduction in value.

Original standard delivery charges will be refunded where required by law.

Return postage costs are only refunded where goods are faulty or supplied in error.


13. Non-Returnable Items

The statutory cancellation right does not apply to:

  • bespoke products;

  • made-to-order products;

  • personalised products;

  • sealed hygiene products once opened;

  • Digital Products once download or access has begun following the customer's express consent.


14. Digital Products

Digital Products are supplied electronically.

By purchasing a Digital Product and requesting immediate access, you expressly agree that:

  • download or access may begin immediately;

  • your statutory cancellation rights end once supply has commenced.

Once supplied, Digital Products are non-refundable except where required by law.


15. Faulty Goods

Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015.

If goods are faulty, not as described or unfit for purpose, please contact us as soon as possible.

Where a fault is confirmed we will, in accordance with your legal rights:

  • repair the goods;

  • replace the goods;

  • provide a full or partial refund where appropriate.

Reasonable return postage costs for faulty goods will be reimbursed.

Damage resulting from incorrect installation, misuse, modification, abuse, neglect or normal wear and tear is not covered.


16. Vehicle Compatibility

Customers are responsible for ensuring products are suitable for their intended vehicle before installation.

Where fitment advice is requested, recommendations are provided in good faith based on the information supplied by the customer.


17. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • any liability which cannot legally be excluded.

Subject to the above, our liability shall not exceed the purchase price of the goods supplied.

We shall not be liable for indirect or consequential losses including loss of profits, business interruption or loss of opportunity.


18. Force Majeure

We shall not be liable for delays or failure to perform caused by events beyond our reasonable control, including but not limited to strikes, supplier failures, transport disruption, fire, flood, pandemics or government restrictions.


19. Intellectual Property

All drawings, CAD files, photographs, instructions, downloadable documents and website content remain the intellectual property of Advanture Ltd unless otherwise agreed in writing.

They may not be copied, reproduced or distributed without permission.


20. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable UK data protection legislation.


21. Governing Law

These Terms shall be governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
